§ 18-614. Records and books required.

  • (a)

    The chief of police, or his designated representative, shall prepare, maintain and make available a list of articles frequently stolen or otherwise illegally acquired by individuals engaged in criminal activities.

    (b)

    Any secondhand store dealer who, in the conduct of business, purchases any article included on said list shall comply with the record and bookkeeping requirements described herein.

    (c)

    If a secondhand store dealer acquires any property on said list, he shall obtain a properly signed bill of sale from the seller evidencing the sale of certain items to said dealer. All bills of sale must be in duplicate and must recite the following separate items:

    (1)

    A bold heading with the words, "Bill of Sale" on the forms.

    (2)

    Date and time of the bill of sale.

    (3)

    Name of secondhand store.

    (4)

    Amount of consideration.

    (5)

    Description of all articles received therein.

    (6)

    Full name, date of birth, and address of the seller.

    (7)

    Driver's license number or social security number of the seller.

    (8)

    Signature of the seller.

    (9)

    Right thumb print of the seller.

    (d)

    The original copy of the bill of sale shall be retained by the secondhand store dealer. The second copy shall be delivered to the seller at the time of sale.

    (e)

    The secondhand store dealer shall keep at his place of business a bound book with consecutively numbered pages in which he shall record in writing, using permanent ink, any purchase totaling $5.00 or more from any individual seller, or any purchase that is traded, bartered, or otherwise conveyed to the secondhand store dealer. When recording the purchase in the bound book, the secondhand store dealer will include the date of the transaction, along with the name, address and identification number of the seller, and a description of the property received from the seller in a manner that will aid in the identification of the property (i.e., manufacturer and model, serial number, style, size, color, etc.).

    (f)

    All property purchased or received by the secondhand store dealer shall be recorded in the bound book within 24 hours of time of possession of the property.

    (g)

    Notwithstanding subsection (e) of this section, the secondhand store dealer may use electronic or computerized recordkeeping methods, instead of the bound book, provided written printouts or hardcopies of the required data are readily available. The dealer may maintain the information required by this subsection in a computer program compatible with a program maintained by the police department or pre-approved by the police department.
