§ 2-308. Firefighter's pension fund.

  • (a)

    1937 Fund. There is created and established for the city a firefighter's pension fund and a board of trustees of the firefighter's pension fund by the common council pursuant to IC 36-8-7-1 et seq.

    (1)

    All of the provisions, conditions, and terms of IC 36-8-7-1 et seq., are adopted as part of this section, the same as if they were fully set forth herein, and the board of trustees elected pursuant thereto shall have and retain all of the rights and powers in the legislative act defined.

    (2)

    It is hereby declared to be the intent and purpose of this section to adopt in full all of the provisions of IC 36-8-7-1 et seq., for the establishment, control, and management of the firefighter's pension fund of the city, and to provide funds for the purpose of carrying out the provisions and purposes of IC 36-8-7-1 et seq.

    (3)

    Upon the death of a disabled, retired, or discharged member of the fire department who was receiving or entitled to receive a pension at the time of his death, or upon the death of a member in active service at the time of his death, the board of trustees shall authorize and pay out of the fund at least $9,000.00 as death benefits. The money shall be paid to the legal representative of the deceased member and is in addition to other benefits paid to a member or survivor under this section.

    (b)

    1977 Fund. There is created and established for the city, by the common council pursuant to IC 36-8-8-1 et seq., a police officers' and firefighters' disability fund.

    (1)

    All of the provisions, conditions, and terms of IC 36-8-8-1 et seq., are adopted as part of this section, the same as if it were fully set forth herein.

    (2)

    It is hereby declared to be the intent and purpose of this section to adopt in full all of the provisions of IC 36-8-8-1 et seq., for the establishment, control, and management of the police officers' and firefighters' disability fund of the city, and to provide funds for the purpose of carrying out the provisions and purposes of IC 36-8-8-1 et seq.

    (3)

    Effective January 1, 1990, the heirs or estate of a fund member is entitled to receive at least $9,000.00 upon the fund member's death.
