§ 46-32. Exceptions to section 46-31.

  • Section 46-31 shall not apply to a child who is:

    (1)

    Accompanied by a child's parent, guardian, or custodian;

    (2)

    Accompanied by an adult specified by the child's parent, guardian, or custodian;

    (3)

    Performing an emergency errand at the written direction of the child's parent, guardian or custodian; or

    (4)

    Participating in, going to, or returning home from:

    a.

    Lawful employment;

    b.

    School-sanctioned activity;

    c.

    A religious event; or

    d.

    An activity sponsored by a civic or public organization or an event which directly involves the child's rights of free speech or assembly protected by the United States Constitution.

    (5)

    Engaged in interstate or intrastate vehicular travel;

    (6)

    On the sidewalk of the place where such child resides, or on the sidewalk of either next-door neighbor not communicating an objection to the police officer.
