§ 50-3. Prohibited acts.

  • (a)

    It shall be unlawful for any person in a city park to:

    (1)

    Drive or park any automobile, truck, trailer, motorcycle, other motor vehicle, or bicycle in any park except on properly designated and maintained roadways and parking areas, or to operate such vehicles through parks after closing hours, except on duly dedicated streets and avenues which extend through the parks and are not closed by the park director.

    (2)

    Willfully or recklessly mark, deface, disfigure, injure, tamper with, displace, or remove any building, bridge, table, bench, fireplace, receptacle, railing, fence, monument, waterline or fountain, electric light or fixture, sign, notice, or other structure, equipment, facilities, or park property of any nature.

    (3)

    Throw, deposit, or cause or allow to be thrown or deposited on any park property any rubbish, garbage, trash, leaves, ashes, paper, debris, glass, metal, rubber, or other refuse of any nature; or to throw, deposit, discharge, or otherwise cause to be placed in the waters of any pool, pond, river fountain, or other body of water in or adjacent to any city park any substance, matter or thing, liquid or solid, which will or may result in the pollution of the waters.

    (4)

    Bring in, deposit, dump, or otherwise leave on park property any bottles, broken glass, ashes, paper, boxes, cans, dirt, rubbish, waste, refuse, or garbage. No refuse or trash generated by park users while in the parks shall be left on the park grounds in the open or placed in any water in or contiguous to the park grounds, but shall be placed in the proper receptacles whenever provided; and whenever proper receptacles are not provided, such trash and refuse shall be carried away from the park by the persons responsible for its presence, and properly disposed of elsewhere.

    (5)

    Pick, cut, break off, or otherwise disfigure any flower, tree, shrub, or plant growing in the parks.

    (6)

    Launch boats into any waterway in or contiguous to park property except at properly designated boat launching ramps or areas.

    (7)

    Bring any controlled substance as defined by the laws of the state, drugs, beer, ale, or any other alcoholic beverage, into any park or consume, or have in their possession, or sell, give away, or handle, any controlled substance, or intoxicating alcoholic beverages, except on written permission from the board of parks and recreation or its duly authorized agents.

    (8)

    No person shall sleep or protractedly lounge on the seats, or benches, or other areas including parking lots; or engage in loud, boisterous, threatening, abusive, insulting or indecent language; or engage in any disorderly conduct or behavior tending to a breach of the public peace in the public parks.

    (b)

    Any gift or donation to honor individuals or events must have written approval from the parks superintendent prior to installation. Any unapproved installation shall be removed by park personnel.
