§ 54-192. Safety procedures.

  • In the event that any building is moved pursuant to the provisions of this division, the holder of the permit obtained pursuant to section 54-188 shall be required to:

    (1)

    Within 48 hours after the time that the building being moved has been lifted from its old foundation from which it is being moved, completely fill in with suitable fill material subject to the approval of the city building commissioner the old foundation or excavation from which the building being moved has been removed;

    (2)

    Until said old foundation or excavation shall be so filled in, erect around such old foundation or excavation a sturdy fence of sufficient materials, size and construction, subject to the approval of the city building commissioner, suitable to prevent any person, particularly children, from falling into the foundation hole or excavation, or from otherwise being injured there. Such fence must fully enclose the foundation hole or excavation from the time that the building being moved has been lifted from its former foundation until the time that the foundation hole or excavation has been completely filled in as required in subsection (1) of this section, excepting for such time or times when the holder of the permit, his contractor, employees or agents is or are personally present at the site of the foundation hole or excavation; and

    (3)

    Maintain a fence of sufficient materials, size and construction, subject to approval of the city building commissioner, around the base of the building being moved after it has been lifted from its foundation and until it is permanently installed upon its new foundation in the location to which it is being moved, sufficient to keep any person, particularly children, from gaining access under the building being moved. Such fence shall completely enclose the base of the building being moved whenever it is not permanently mounted on a foundation except during any time when the holder of the permit or his contractor, employees or agents are personally present at the site of the building being moved; and

    (4)

    Complete the moving of the building in question by permanently placing the building on its new foundation in the location to which it is being moved within ten days after the date of issuance of the permit pursuant to section 54-188.
