§ 58-414. Definitions.

  • The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Bicycle means any vehicle coming within the common definition of the term, having one or more wheels, including, but not limited to, unicycles and tricycles.

    Downtown business district means the real estate within the city, described as follows: commencing at the intersection of the centerline of Grove Street and Elizabeth Street; thence east, along the centerline of Grove Street to the centerline of Sarah Street; thence South along the centerline of Sarah Street to the south right-of-way line of Mishawaka Avenue; thence west along the south right-of-way line of Mishawaka Avenue to the east right-of-way line of Main Street; thence south along the east right-of-way line of Main Street to the north bank line of the St. Joseph River; thence south and east along the north bank line of the St. Joseph River to the center-line of Race Street (if projected north to the river's south bank); thence south along the (extended) centerline of Race Street to the centerline of Lincolnway East; thence west along the centerline of Lincolnway East/US 33 to the centerline of Church Street; thence south along the centerline of Church Street to the centerline of Third Street; thence east along the centerline of Third Street to the centerline of Race Street; thence south along the centerline of Race Street to the centerline of Fourth Street; thence west along the centerline of Fourth Street to the east right-of-way line of Church Street; thence south and east of along the east right-of-way line of Church Street to the south right-of-way line of the Conrail Railroad; thence west along the south right-of-way line of the Conrail Railroad to the centerline of Spring Street; thence north along the centerline of Spring Street to the centerline of Fourth Street; thence west along the centerline of Fourth Street to the centerline of West Street; thence north along the centerline of West Street to the south right-of-way line of Lincolnway West; thence west and southwest along the south right-of-way line of Lincolnway West to the east right-of-way line of Logan Avenue; thence north along the east right-of-way line of Logan Avenue to the north bank line of the St. Joseph River; thence east and north east along the north bank line of the St. Joseph River to the east right-of-way line of Forest Avenue; thence north along the east right-of-way line of Forest Avenue to the south right-of-way line of Mishawaka Avenue; thence east along the south right-of-way line of Mishawaka Avenue to the centerline of Elizabeth Street; thence north along the centerline of Elizabeth Street to the point of beginning.

    Public property means any real estate in which any governmental entity or subdivision has any right, title or interest, whether by ownership, lease or otherwise. This shall include, but not be limited to, streets, sidewalks, parks, municipal parking lots and the riverwalk.

    Public right-of-way means any real estate dedicated for or over which the public has a general right of passage.

    Rollerskate/rollerblade means a shoe, boot, or mechanism designed to attached to a shoe, boot or a person's foot, which is mounted upon one or more wheels.

    Scooter means any wheeled vehicle which is propelled by motor or by its operator by resting a portion of his body weight upon the vehicle while pushing against the ground with another portion of the operator's body. The term shall not include a wheelchair or wheelchair-like device used primarily to aid disabled individuals' mobility.

    Skateboard means a board consisting of manmade or natural material which is mounted upon wheels.
