§ 58-415. Riding on roadways, bicycle paths, and sidewalks.

  • (a)

    Every person operating a bicycle on a roadway shall ride as near to the right side of the roadway as practicable, exercising due care when passing a standing vehicle or one proceeding in the same direction.

    (b)

    Wherever a usable path for bicycles has been provided adjacent to a roadway, bicycle riders shall use the path and shall not use the roadway.

    (c)

    No person shall ride a bicycle on the sidewalk or on any public right-of-way within the downtown business district, except in such places as are marked as bicycle paths. Bicycle paths shall consist substantially of the public streets and the riverwalk. Bicycles must be walked through nonriverwalk sections of the parks.

    (d)

    No person shall operate or ride a scooter, motorized scooter, or skateboard on any public right-of-way within the downtown business district.

    (e)

    This section shall at no time prohibit disabled individuals using mobility assistance devices from the use of any public sidewalk or space. Nor shall police officers patrolling the district on bicycles be prohibited from the use of any public sidewalk or space.

    (f)

    The chief of police is authorized to erect signs on any sidewalk or roadway prohibiting the riding of bicycles thereon and/or requiring bicycles to be parked and secured or walked by any person, and when the signs are in place, no person shall disobey them.

    (g)

    Whenever any person is riding a bicycle on a sidewalk, he shall yield the right-of-way to any pedestrian and shall give audible signal before overtaking and passing the pedestrian.
