§ 58-470. Truck routes.

  • (a)

    Definitions. The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Truck means a vehicle with an overall length of 20 feet or more, or over one-ton capacity, and includes semitrailer trucks and either the tractor pulling the same, or the trailer itself. The term "truck" includes every self-propelled commercial vehicle used for the transport of goods or property described as follows:

    (1)

    From a point outside the city through the city to a point outside the city;

    (2)

    From a point outside the city to a point within the city limits;

    (3)

    From a point within the city limits to a point outside the city limits; or

    (4)

    From a point within the city limits to a point within the city limits.

    (b)

    Truck routes. Neither the driver nor the owner or lessee of a truck shall allow any of the following:

    (1)

    No truck as previously defined herein shall be operated in the corporate limits of the city except upon the following streets and parts of streets shown upon a map entitled "Schedule VI," incorporated herein by reference. At least two copies of said map shall be on file in the office of the clerk for public inspection. Such streets and parts of streets are hereby designated as official truck routes:

    (2)

    Trucks traveling from a point outside the city through the city to a point outside the city shall enter the city and proceed to the point within the city which is their destination in accordance with the shortest combination of state or federal highways and city truck routes as shown upon a map entitled Schedule VI.

    (3)

    Trucks traveling from a point outside the city to a point within the city limits shall follow state or federal highways or city truck routes as shown on Schedule VI from the point upon such routes which is nearest to their point of beginning. They shall not travel upon any other public streets of the city, except as provided in this section.

    (4)

    Trucks traveling from a point within the city limits to a point outside the city limits shall proceed from the point within the city which is their starting point to the city limits by the shortest combination of state and federal highways and city truck routes shown upon Schedule VI.

    (5)

    Trucks traveling from a point within the city limits to another point within the city limits shall proceed from the point within the city which is their starting point to the nearest truck route or state and federal highway, as shown upon Schedule VI.

    (c)

    Restrictions. Neither the driver nor the owner or lessee of a truck shall allow any of the following:

    (1)

    No truck shall be operated upon any public streets not designated as a truck route in Schedule VI of the city at any time; provided that such trucks may be permitted upon such other public streets of the city, upon the direction of a city or state police officer, to follow a marked and established city detour, or to obtain necessary emergency mechanical repairs.

    (2)

    All trucks as defined in this section shall proceed by the shortest combination of state and federal highways and city truck routes shown upon Schedule VI, and shall be prohibited from driving upon other city streets unless said trucks are in the process of delivering or picking up goods, in which event, said trucks shall utilize only the most direct truck routes, which will allow said trucks to arrive as close to their pickup and delivery point as possible and only then shall said trucks be permitted to utilize nontruck routes. A driver must produce a written bill of lading or similar document if stopped while driving on a city street which is not designated as a city truck route as shown in Schedule VI or detour route to verify compliance with these restrictions.

    (3)

    All trucks within the city as defined in this section when finished delivering or picking up goods shall return to the nearest truck route by the most direct route. This includes such trucks which have additional destinations within the city. Shortcuts on non-truck-routes are expressly prohibited.

    (4)

    No truck shall stop, stand, or park on any street in this city other than for the immediate loading or unloading of freight, except in cases of emergency when such truck is broken down and unable to move, and except also in the event a moving van is loading or unloading furniture and household goods, or the furniture, equipment, goods, wares, and merchandise of a business. In either of these events the operator of such truck will have a reasonable time in which to complete his loading or unloading and move his truck. Any truck so stopped, standing, or parked may be impounded and towed at the direction of a city police officer at the expense of the owner or lessee in order to promote the safe and free flow operation or traffic in the city.

    (d)

    Exceptions. The provisions of this section do not apply to vehicles operating upon tracks, common carriers of public passengers, service vehicles operated by a public utility, or vehicles operated by the city or its contractors.

    (e)

    Signs. The traffic department is hereby authorized to cause all streets and portions thereof established and designated by this section as truck routes to be clearly marked or signposted at their intersections with other truck routes or boundary lines of the city with appropriate signs displaying in letters not less than four inches in height the words "truck route."
