§ 62-481. Definitions.

  • Authority shall mean the utility board, as designated by ordinance and/or its authorized deputy, agent, or representative.

    Authorized representative of food service establishment.

    (1)

    In the case of an independently-owned establishment, the owner shall serve as the authorized representative. The owner may designate a representative, provided that representative is responsible for the overall operations of the establishment;

    (2)

    In the case of a partnership or proprietorship, a general partner or proprietor shall serve as the authorized representative. The general partner or proprietor may designate a representative, provided that representative is responsible for the overall operations of the establishment;

    (3)

    In the case of a corporately-owned establishment, the corporation shall be responsible for designating an authorized representative for each facility operating in the city. The authorized representative designated for each location shall be an individual responsible for the overall operations at that location.

    Engineering standards shall mean the latest edition of the City of Mishawaka Engineering Standards, as approved by the City of Mishawaka Board of Public Works and Safety.

    FOG—Fats, oil, and grease means any fats, oils, and greases generated from the food preparation process, as identified by the most current EPA method listed in 40 CFR 136.3.

    FOG management system means the system of devices and/or procedures in place at a facility to minimize FOG in the sewer lines.

    Food service registration means a registration form required by the City of Mishawaka for each food service establishment operating within the city. The form shall be completed in full by an authorized representative of the facility.

    Food service establishment means food preparation facilities including, but not limited to, restaurants, banquet halls, cafeterias, and hospitals. In addition, all food manufacturing facilities.

    Grease-control device means any grease interceptor or grease trap installed at a food service establishment as part of a FOG management system.

    Grease interceptor means a passive tank installed in the building sewer outside of a building designed to remove fats, oils, and grease from flowing wastewater while allowing wastewater to flow through it.

    Grease trap means an indoor system designed to remove fats, oils, and grease by physical separation from flowing wastewater.

    Remedial action plan means a written plan required when a food service establishment is found to be in violation of this article. The plan shall detail the steps the facility will take to correct the violation, the time frame for the violation to be corrected, and will be signed by an authorized representative of the facility.

    Sanitary sewer permit means a permit required by the City of Mishawaka engineering department for construction, excavation, and inspection of any new or proposed modifications to FOG management system devices.
