The plan commission, or its designee, may impose conditions as part of any design
review application provided the conditions are consistent with the intent of this
chapter and are reasonably necessary to satisfy any applicable development requirement.
The plan commission, or its designee, may also require a performance bond or other
written assurance that requires the timely completion of public improvements within
or associated with a given project. To ensure projects are completed as presented,
the plan commission, or its designee, may permit or require the owner of real property
to make a written commitment in accordance with IC 36-7-4-613. The plan commission,
or its designee, may accept commitments from the agent of the owner of real property
only where the owner has provided the written consent for the agent to act as the
legal representative of the owner.
