§ 117-34. Bonding requirements.
No land user shall begin a land disturbing activity subject to this chapter without receiving prior submission of a surety bond or an irrevocable letter of credit where required. Administration of surety bonds or letters of credit shall rest with the department of engineering. The amount of the surety shall be as identified by this chapter and shall be submitted prior to or concurrently with an improvement location permit to the department of engineering. Surety shall be provided throughout the time of land disturbing activity operations. Surety bonds or an irrevocable letter of credit shall be required as follows:
(1)
Light land disturbing activity: No surety required.
(2)
Moderate land disturbing activity: No surety required.
(3)
Substantial land disturbing activity: Surety required.
