All permanent stormwater management systems identified in the post-construction stormwater
pollution prevention plan (SWPPP), including detention or retention basins, filter
strips, infiltration systems, conveyance systems, and structures located outside of
the right-of-way shall be designated as common areas or incorporated into permanent
easements. For the purposes of access, monitoring, inspection, and general maintenance
activities, an adequate easement width beyond the actual footprint of the stormwater
quality management facility as well as a 20-foot-wide access easement from a public
right-of-way to each BMP shall be provided. The easement requirements noted may be
changed by the city as deemed necessary for specific cases.
