§ 117-105. Failure to maintain permanent measures.
Latest version.
The responsible party must ensure that all permanent stormwater management measures
are maintained so that they operate according to the approved design. If a responsible
party fails or refuses to perform the required maintenance, the city, after reasonable
notice, may correct a violation of the design standards or maintenance needs by performing
all necessary work to place the facility in proper working condition. If the erosion
control/stormwater management facility becomes a danger to public safety or public
health, the city shall notify the party responsible for maintenance of the facility,
in writing. Upon receipt of that notice, the responsible person shall immediately
effect maintenance and repair of the facility in an approved manner. After proper
notice, the city may assess the owner of the facility for the cost of repair work
and any penalties.
