§ 46-1. Penalty for violation of chapter.

  • (a)

    Curfew. The custodial parent or legal guardian of any child who commits a curfew violation, as defined herein, shall be subject to the following fines:

    (1)

    Twenty-five dollars for a first offense, plus court costs;

    (2)

    One hundred dollars for a second offense within a one-year period, plus court costs; or

    (3)

    Two hundred dollars for a third offense and every subsequent offense within a one-year period, plus court costs.

    (b)

    Alcoholic beverages. An officer of the city police department may issue a city ordinance violation citation to a person who violates sections 46-108 or 46-109. The first citation issued to an individual shall impose a $50.00 fine. Each subsequent citation issued to an individual shall impose a penalty not less than $100.00 and not more than $2,500.00.

    (c)

    Provisions where no penalty specified. Whoever violates any provision of this chapter for which no penalty is specified shall be subject to such penalties as are provided in section 1-7.

    (d)

    Ultimate fighting. Any person found in violation of any provision of article VI of this chapter shall be fined not less than $1,000.00 nor more than $2,500.00 for each violation. Every day that a violation occurs shall constitute a separate offense.
