§ 133-173. Required improvements.

  • (a)

    All lot corners shall be marked by a monument constructed of ferrous pipe or bar at least 24 inches in length and one-half inch in diameter. The top of the monument is to be set level with the established grade of the ground.

    (b)

    Proper and adequate provision shall be made by the subdivider for drainage to provide for the disposal of stormwater. The developer shall sod all drainage swales that exceed a two percent gradient. The city engineer shall review the subdivision plans in order to assist in determining the location, capacity, and extent of drainage swales.

    (c)

    The subdivision shall be provided with a complete public or private sewer and water system. If the sewer system is to become part of the public system, the work shall be done in conformance with plans, profiles, and specifications prepared by a registered engineer or registered land surveyor, and all work shall meet the construction standards as adopted by the board and the state board of health prior to the commencement of construction.

    (d)

    If publicly owned sidewalks are to be constructed, the sidewalks shall be constructed on both sides of the street in conformance with standards as adopted by the board. The board may temporarily waive construction of public sidewalks in order to prevent damage to the sidewalks during construction of the buildings in the subdivision.

    (e)

    If publicly owned street lights are to be installed, the system shall be installed with underground wiring and shall be constructed in accordance with standards as adopted by the board.

    (f)

    Trees of a variety approved by the board may be planted in the tree lawn if the street will be publicly owned. Trees shall be spaced no closer than 40 feet apart. The trees shall be no less than two inches in caliper diameter, and shall be located so as not to interfere with public lighting once the trees are mature.

    (g)

    If streets are to become publicly owned, they shall be constructed according to specifications and profiles designed by a registered engineer or registered land surveyor, and shall meet the latest standards as approved by the board. Horizontal and vertical alignment shall be reviewed with the city engineer.

    (h)

    If streets are to become publicly owned, curbs and gutters shall be constructed according to specifications and profiles designed by a registered engineer or registered land surveyor and meeting the latest standards as approved by the board. Privately owned streets shall be paved.
